Baionic B.V. ("we", "us", "our platform") is committed to protecting your personal data. In this privacy statement, we explain which data we collect, why we do so, and how we protect it in accordance with the General Data Protection Regulation (GDPR).
1. What data do we collect?
We collect data necessary for the functioning of the AI marketplace:
Account Information: Name, email address, password, and profile information.
Payment Information: Financial information for transactions (processed via our partner Stripe).
Communication: Messages sent through the chat functionality on the platform.
Project Data: Content of assignments, uploaded files, and AI output results.
2. Purposes of processing
We use your data for the following purposes:
Facilitating the marketplace: Matching Clients and Freelancers.
Payment processing: Securely managing funds through the Escrow service.
Dispute resolution: In the event of a conflict (as described in Article 17 of the Terms of Service), Baionic has the right to access chat histories and shared files to provide a binding recommendation regarding payment.
Safety and Security: Preventing fraud, abuse, and circumvention of the platform.
3. Sharing with third parties
Baionic only shares data with third parties when necessary for our services:
Sharetribe: For the technical infrastructure and hosting of the platform.
Stripe: For secure payment processing and identity verification (KYC).
Users among themselves: We share necessary contact details between Client and Freelancer once an Agreement has been established.
4. Retention period
We do not store data longer than necessary for the stated purposes. Financial data is kept in accordance with statutory tax retention obligations (usually 7 years). Accounts that have been inactive for more than 12 months may be deleted.
5. Security of AI Data
Given the nature of our platform, we take extra measures regarding AI-related data:
• We do not use data from assignments to train our own AI models without explicit consent.
• Users are personally responsible for the sensitivity of the data they enter into AI tools via our platform.
